Character of Discharge Claims
Often times veterans who have a discharge on their DD214 for conditions other than honorable, are barred and restricted from obtaining the VA benefits that they would normally be entitled to if they were discharged under honorable conditions. Many veterans feel that this is the end of the line for them when it comes to benefits. However, by knowing your legal rights, you may be able to overcome this bar.
Sometimes it is beneficial to try and upgrade your discharge through the appropriate branch of service. Other times, it may simply mean developing the medical evidence you need to overcome the bar that the VA has set before you due to your character of discharge on your DD214. To overcome the bar, in a general sense, you can show that the reason for your discharge was due to a condition or injury that would be service connected. For example, a medic in Vietnam who was discharged for drugs may argue that he had PTSD which lead to his drug abuse that ultimately became the basis for his discharge. While not a guarantee for victory, proper planning and medical evidence may be the key to overcoming a character of discharge claim.
