How Long Will a Case Take?
We are often asked how long will a case take? This question is challenging to answer as there are three things that impact on the speed of the case.
1. How complex are the issues? If you are appealing a case that has 9 issues versus a case isolated to one or two issues, then it will more likely than not take a longer time to get your case resolved. To speed things along consider addressing only those claims that are strongest and that can move you down the road to a higher rating more quickly.
2. Do you have evidence? Do you need to develop new evidence? Are you willing to create some new and relevant materials for the VA. If all you do is just submit new medical records without assessing the real legal issues behind any VA denial, then your chances for success are minimal. However, we move cases more quickly by focusing on the real crux of the legal arguments before the VA and focusing on developing that evidence.
3. Waive the hearing! More often than not a veteran does not need a hearing. If you can adequately identify the issues and the evidence, you need you can forego the hearing. Hearings are generally not necessary if you put your evidence together in a simple and concise manner.
